What is LMIA?

To attract foreign skilled workers and their families that can be part of the country's growth and to make a positive impact on cultural diversity Canadian government launched the LMIA program. This document is issued by Employment and social development Canada(ESDC). Under this program, Canadian employers can send letters of invitation to potential employees, allowing them to apply for work permits and temporary residence in Canada.

Who can Apply for LMIA?

Canadian Employers can apply for LMIA to hire a foreign employee through certain work permit programs. It is the employer's responsibility to submit an LMIA application, not that of the potential employee. No particular sectors or industries are required to qualify for an LMIA application. Following are the points that define that you are eligible for the LMIA program:

  1. Being an authorized company in operation that offers products or services in Canada.
  2. Having the ability to pay foreign employees the established salaries.
  3. Proving a genuine need for foreign labor.
  4. Having no outstanding issues with compliance.
When to apply?

The time to get applied for the LMIA depends upon certain which define the condition for the employer as well the dependence of the employees on that person. It includes factors like the financial condition as well as the job position applied for. 

A PGWP typically cannot be extended. However, Canada has announced that it will extend post-graduation work permits for up to 18 months in order to keep highly skilled talent in the country. PGWP holders who are qualified for the facilitative process will be informed via messages to log into their online IRCC Secure Account on April 6, 2023, to choose to participate and update important personal data.
